This AI Content & Safety Policy sets out the content rules that apply to every prompt, upload and generation made through GeniusAI.

GeniusAI is operated by Dunatransit Ltd., company registration number 01-09-386254, with its registered address at Pannonhalmi utca 31, 1118 Budapest, Hungary.

This policy forms part of our Terms of Service.

GeniusAI is committed to providing a safe, responsible, and legally compliant AI image generation platform. This AI Content & Safety Policy explains what types of content may and may not be created, uploaded, modified, generated, shared, or distributed through our services.

By accessing or using GeniusAI, you agree to comply with this Policy, our Terms of Service, and all applicable laws and regulations.

GeniusAI is designed to support lawful creativity, design, education, marketing, entertainment, artistic expression, and other legitimate uses of artificial intelligence.

We aim to:

• Protect user safety, dignity, and privacy;
• Prevent misuse of generative artificial intelligence;
• Reduce the risk of deception, impersonation, fraud, and abuse;
• Protect intellectual property, privacy, and publicity rights; and
• Comply with applicable laws, regulations, and industry standards.

Users may not use GeniusAI to request, upload, create, edit, generate, enhance, publish, distribute, or share content that violates this Policy.

3.1 Adult, Nude, and Sexually Explicit Content

GeniusAI does not permit the creation, editing, enhancement, or distribution of:

• Pornographic content;
• Explicit nudity;
• Sexually explicit images or depictions of sexual acts;
• Content primarily intended for sexual arousal or gratification;
• Fetish or sexually exploitative content;
• AI-generated intimate imagery;
• Sexually explicit AI companion or erotic roleplay imagery;
• Images created through “nudify,” “undress,” or clothing-removal requests;
• Sexualized depictions of identifiable individuals; and
• Non-consensual intimate imagery.

Non-sexual artistic, medical, scientific, or educational depictions of the human body may be permitted when lawful, appropriate, and clearly not intended for sexual gratification. GeniusAI reserves the right to block such content where context, presentation, or intent cannot be reliably verified.

3.2 Deepfakes, Face Swaps, and Impersonation

Users may not use GeniusAI to:

• Create deceptive or harmful deepfakes;
• Impersonate another individual;
• Falsely represent that a real person said, did, or participated in something;
• Create realistic face swaps involving identifiable individuals without authorization;
• Create misleading synthetic media presented as authentic;
• Manipulate photographs or videos of real people in a deceptive or harmful manner;
• Create fake evidence, fabricated events, or misleading public statements;
• Create content intended to facilitate fraud, defamation, harassment, blackmail, or reputational harm; or
• Create sexual or intimate deepfakes involving any real or identifiable person.

3.3 Real and Identifiable Individuals

Users may not create or edit content involving a real or identifiable person in a manner that:

• Violates their privacy or publicity rights;
• Is defamatory, threatening, deceptive, or harassing;
• Depicts them nude, sexually, or intimately without clear authorization;
• Falsely depicts criminal, abusive, unethical, or embarrassing conduct;
• Misrepresents their identity, views, actions, or affiliations; or
• Could reasonably cause emotional, professional, financial, or reputational harm.

This restriction applies to:

• Private individuals;
• Celebrities;
• Influencers and content creators;
• Politicians and public officials;
• Business leaders and public figures; and
• Minors.

3.4 Child Safety

Any sexual, exploitative, abusive, suggestive, or otherwise inappropriate content involving minors is strictly prohibited.

Prohibited content includes, without limitation:

• Child sexual abuse material;
• Sexualized depictions of minors;
• Content that appears to depict minors in intimate or exploitative situations;
• Requests to make a person appear younger for sexual purposes; and
• Content that promotes grooming, exploitation, or abuse of minors.

Attempts to create such content may result in immediate account termination and may be reported to relevant authorities or child-safety organizations where required or permitted by law.

3.5 Violence, Gore, and Harmful Content

Users may not generate or distribute:

• Graphic gore or extreme violence;
• Torture, mutilation, or dismemberment;
• Content that glorifies terrorism or violent extremism;
• Content that encourages suicide, self-harm, or harm to others;
• Images intended to threaten, intimidate, or terrorize another person; or
• Instructions or promotional material supporting violent criminal activity.

3.6 Illegal, Fraudulent, or Deceptive Activities

GeniusAI may not be used to facilitate, promote, or support:

• Fraud or financial scams;
• Identity theft or impersonation;
• Phishing or social engineering;
• Counterfeit identity documents, licenses, passports, certificates, invoices, or financial records;
• Forgery or fabricated evidence;
• Blackmail, extortion, or coercion;
• Illegal weapons or criminal activity;
• Illegal drug production, promotion, or distribution; or
• Any activity that violates applicable law.

3.7 Hate, Harassment, and Extremism

Users may not create content that:

• Promotes hatred or discrimination against protected groups;
• Incites violence against individuals or communities;
• Contains extremist propaganda or recruitment material;
• Harasses, humiliates, intimidates, or threatens another person; or
• Promotes dehumanization, abuse, or targeted discrimination.

3.8 Intellectual Property and Rights of Others

Users must not knowingly use GeniusAI to infringe copyrights, trademarks, trade secrets, publicity rights, privacy rights, or other legal rights.

Users must have all necessary rights, permissions, and lawful authority to upload, edit, transform, or generate content based on third-party materials or identifiable individuals.

3.9 Political and Public-Interest Deception

Users may not create deceptive synthetic content intended to:

• Mislead voters or interfere with elections;
• Falsely depict statements or actions by political candidates or public officials;
• Fabricate public emergencies, conflicts, crimes, or official announcements; or
• Manipulate public opinion through materially deceptive impersonation.

GeniusAI may use automated moderation systems, filters, classifiers, and other safety mechanisms to identify prompts that may violate this Policy.

Prompts requesting prohibited content may be rejected before image generation begins. GeniusAI is not required to provide detailed information about its moderation systems or explain how a particular safety decision was made.

Attempts to bypass, manipulate, evade, or disable moderation safeguards are prohibited.

Generated content may be reviewed using automated systems or manual review processes.

If content is suspected or determined to violate this Policy, GeniusAI may:

• Refuse or interrupt generation;
• Block access to generated content;
• Remove or delete content;
• Prevent content from being downloaded, published, or shared;
• Restrict specific platform features; or
• Suspend or permanently terminate the associated account.

Safety systems may occasionally block lawful content or fail to detect prohibited content. The existence of moderation systems does not transfer responsibility for user activity or generated content to GeniusAI.

Users are responsible for:

• All prompts they submit;
• All images, files, and materials they upload;
• All content generated through their account;
• Ensuring they have the necessary rights and permissions;
• Reviewing generated content before using or distributing it;
• Complying with applicable laws and third-party rights; and
• Ensuring that generated content is not used deceptively or harmfully.

Users must not represent AI-generated content as authentic evidence, journalism, documentation, or an official statement where doing so could mislead others.

GeniusAI may investigate suspected violations and take enforcement action at its reasonable discretion.

Enforcement measures may include:

• Prompt rejection;
• Content removal;
• A warning or compliance notice;
• Temporary feature restrictions;
• Temporary account suspension;
• Permanent account termination;
• Cancellation of access to paid services;
• Preservation of relevant records; or
• Reporting to payment providers, law enforcement authorities, regulators, or safety organizations where legally required or reasonably necessary.

Serious violations, including child exploitation, non-consensual intimate imagery, fraud, or attempts to evade safety safeguards, may result in immediate termination without prior notice.

Users whose accounts, generations, or platform access are restricted or terminated because of a violation of this Policy may not be eligible for a refund, except where required by applicable law or expressly stated in our Refund Policy.

If you believe content created, uploaded, or distributed through GeniusAI violates this Policy, applicable law, or your legal rights, please contact us.

Please include, where available:

• A description of the reported content;
• The relevant URL, account, generation, or content identifier;
• An explanation of why the content violates this Policy;
• Evidence that you are the affected person or authorized representative, where relevant; and
• Any supporting documentation reasonably necessary to investigate the report.

GeniusAI may remove or restrict content while a report is being reviewed.

GeniusAI may preserve, disclose, or provide relevant information where required by law, valid legal process, regulatory obligations, payment-provider requirements, or legitimate child-safety and abuse-prevention procedures.

We may also cooperate with hosting providers, payment processors, technology partners, law enforcement authorities, regulators, and recognized safety organizations when investigating serious violations.

We may update this AI Content & Safety Policy from time to time to reflect changes to our services, moderation practices, legal requirements, technology, or safety standards.

The updated Policy becomes effective when published on the GeniusAI website, unless a later effective date is stated.

Continued use of GeniusAI after an updated Policy becomes effective constitutes acceptance of the revised Policy.
